Hire Agreement
In consideration of the hiring fee payable by me to the owner Manly Kayak Centre, I agree to hire the equipment (Boat/kayak/ accessories) described at the bottom of this agreement, under the following terms and conditions:
1. I acknowledge that the owner has provided me with a copy of the operating area applicable to the EQUIPMENT and issued by the NSW Maritime, and that I have read and CLEARLY UNDERSTOOD the contents thereof and that I shall not take the hire equipment beyond an imaginary line drawn between the eastern end of REEF BEACH and the flagpole on CANNAE POINT (Quarantine Headland).
2. I further acknowledge that I have examined the hire equipment and am satisfied that it is in proper seaworthy condition and is equipped with all required safety equipment listed below in accordance with the NSW Maritime and that Manly Boat and Kayak Hire has clearly and completely explained the operation of such equipment to me.
3. I undertake not to carry more than the maximum limit of people authorized by Manly Boat and Kayak Hire and NSW Maritime as listed: (1) single kayak; (2) double kayak; (3) triple kayak; (5) self drive leisure boat (age of users do not interfere or change listed limit). I also agree not to use the equipment between sunset and sunrise.
4. I agree that I shall be wholly responsible for the hire equipment, its passengers and appliances and third parties whilst the vessel/kayak or equipment is in my control for the period of hire and that I shall exercise due care and accept responsibility, during the same period, toward any incident that may occur, and will promptly reimburse Manly Kayak Centre in the event of any loss or damage to the equipment and or to any other person or property.
5. I agree to return the hire EQUIPMENT to Manly Boat and Kayak Hire at the point of hire on completion of the agreed period detailed below and by no later than sunset today. I also agree to pay for any delays.
6. I acknowledge and agree that the hiring of the equipment is entirely at my OWN RISK, ,is a dangerous activity, and that I shall indemnify Manly Boat and Kayak Hire of any incident, loss or damage to the EQUIPMENT, any third party person or property during the period of the hiring and acknowledge that I will not be covered by any of Manly Boat & Kayak Hire’s insurance if found negligent or irresponsible whilst the boat/kayak or any equipment that is under my control. I also acknowledge the term “under my control” means that I am responsible for the boat/kayak or equipment at all times regardless of whoever else is operating riding or using the equipment for the duration of the hire, which also includes late returns.
7. I acknowledge that failure by me to observe and obey the operating area advised and contained on the map will result in a penalty of $200.00 being imposed, as well as any other charge related to any incident, damage or loss to the EQUIPMENT or other parties involved.
8. I also acknowledge that the Boat / kayak is fitted with the following operational and safety equipment:

By signing this HIRE AGREEMENT I am agreeing that all occupants of the EQUIPMENT will comply with all reasonable instructions, both written and verbal, issued by the staff of Manly Boat & Kayak Hire. Any occupant deemed to be acting dangerously or irresponsibly during the hire period may cause the hire to be cancelled without refund.
